Terms & Conditions 


1. Payment and Fees:
a. The Client agrees to pay Thursday Photography the total fees for the photography services as outlined in these terms and conditions and per the online booking.

b. Deposits are due no later than 14 days prior to the scheduled appointment.  if the deposit has not been received by this date, the appointment will be cancelled.  For appointments booked for a session occurring within 14 days, deposits are due within 24 hours.  The remaining balance is due prior to the release of the digital proof gallery.  Payments can be made online, or e-transfers can be sent to: thursday.fotos@gmail.com

c. If applicable, additional expenses, such as travel costs, will be agreed upon in writing between the client and Thursday Photography.

 

2. Cancellation and Rescheduling:
a. Cancellations up to 14 days prior to the scheduled photography session date will receive a full refund of any monies paid.  If the client cancels or reschedules the session within 14 days of the scheduled appointment, any deposits paid are non refundable, but will be applied to a photography session on a future date and time. The client is responsible for paying the difference in price if pricing increases have occurred or if the client wishes to purchase additional services.

b. For newborn photography booked prior to the birth, we understand that the session date may need to be adjusted depending on the baby’s arrival. We will do our best to accommodate  and adjust the date and time as needed.

c. If the event/session is canceled or rescheduled by Thursday Photography due to unforeseen circumstances (e.g., illness, emergency), Thursday Photography will offer the Client the option to reschedule or receive a full refund of the deposit.

d. If an online booking is made for a session location outside of our coverage area (Calgary, Okotoks, Airdrie, Chestermere), Thursday Photography has the right to cancel the booking and refund any monies paid.

e. Thursday Photography cannot guarantee the participation of all participants in the photography session.  The client and other participants are responsible for their own appearance (clothing, hair style etc.) We will work to address your concerns, but anything outside of the photographers control does not constitute a reshoot.

3. Ownership and Usage Rights:
a. Thursday Photography retains all copyright and ownership of the images captured during the event/session. 

b. The Client is granted personal, non-commercial usage rights to the images. This includes the right to print, share, and display the images for personal use only. 

c. The Client agrees not to edit or alter the images without Thursday Photography's express written consent. 

d. If the client agrees as per the model release statement, Thursday Photography reserves the right to use the images for promotional purposes, including but not limited to portfolio, website, social media, and marketing materials.

4. Image Delivery:
a. Thursday Photography will provide the Client with a selection of lightly edited digital images from the session. The number of lightly edited images may vary.  The lightly edited digital images will be delivered by email in an online proof gallery in approximately 5-7 days after the photography session. The Client will then have the option to select images for final editing and retouching. These images will then be available in an online gallery as high-resolution Jpeg files for digital download.  Additional edited digital images are available at a cost of $10.00 per image or 10 for $75.00.

b. Once the client has finalized and submitted their favorites, final editing will take approximately 2-3 weeks to complete.

5. RAW image Files:
a. As per industry standards, Thursday Photography DOES NOT provide the RAW image files to clients. These files are unprocessed and unedited files that lack the finishing touches, adjustments and enhancements that give the final photograph its polished and professional appearance. By providing RAW files we would relinquish control over how those photographs are presented, potentially leading to images that do not represent or align with our brand or artistic talent.

6. Indemnification: 

a. The Client agrees to indemnify and hold harmless the Photographer from any legal actions, claims, or damages resulting from the Client's actions or omissions during the event/session.

 

7. Limitation of Liability: 

a. In the unlikely event of photographic equipment failure, theft, or other unforeseen circumstances beyond the Photographer's control, the Photographer's liability is limited to the refund of the total fee paid. 

b. The Photographer is not liable for any indirect, incidental, or consequential damages.

8. Governing Law: 

a. This Agreement shall be governed by and construed in accordance with the laws of Alberta & Canada.

 

9. Pricing

a. Thursday Photography reserves the right to increase/decrease pricing at any time, unless a previously signed agreement or valid online booking is in place with a specific service/date noted in writing. The agreement must have been accepted by both parties before the expiry date.

 

10. Entire Agreement: 

a. This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, whether written or oral. By checking the box, the client acknowledge that they have read and understood the terms of this Photography Agreement and agree to be bound by its terms.
